IMCO is preparing two reports, one on the proposal for a directive amending Directive 2013/11/EU on alternative dispute resolution for consumer disputes, as well as Directives (EU) 2015/2302, (EU) 2019/2161 and (EU) 2020/1828 and another on the proposal for a regulation repealing Regulation (EU) No 524/2013 and amending Regulations (EU) 2017/2394 and (EU) 2018/1724 with regards to the discontinuation of the European ODR Platform. The Rapporteur is Ms Laura Ballarín Cereza (S&D).
The Rapporteur's main
political lines are to raise consumer awareness of ADR and increase
trader participation in ADR schemes. As regards territorial scope, she
proposes to extend the directive to cover traders established outside
the EU. As regards material scope, she again proposes to extend the
coverage of the directive to subject-matter such as noncontractual
obligations, pre-contractual obligations, dark patterns and unfair
commercial practices.
On the proposal concerning the discontinuation of the ODR platform, the Rapporteur aims to make the repeal of the ODR Regulation, follow from the entry into force of the new ADR proposal. Given that the latter contains a provision to introduce into the ADR directive a new digital interface tool, the Rapporteur is of the view that this should be in place before the ODR platform is discontinued.
The vote in committee is planned for 22 February 2024.
